The Trump legal team motion before Aileen Cannon has now been upheld, with the dismissal of the entire case against Trump in the Documents case in the Florida District Court, with a 93 page decision from Cannon.
Numerous motions to dismiss cases under the idea that Special Counsel appointments are unconstitutional have been filed ever since the Independent Council statute expired in 1999. None of them have ever before been upheld.
Technically the DOJ could dismiss the case in the Southern District in Florida, and refile it in a different venue, for instance in the District of Columbia. But Chuck Rosenberg on MSNBC this morning thought that latter thing, seen as “judge shopping” on the part of the DOJ, would be a bad move.
Months if not a year or more before DOJ will get an appeal of this decision from Judge Cannon through the Appellate courts.
Trump has, at least for now, slipped out of facing Justice for his actions regarding National Security Documents.
One has to wonder if the Hunter Biden legal team will now appeal his conviction on the same basis which Cannon dismissed the case against Trump. Since David Weiss was the special counsel who oversaw the case against Hunter Biden.
